This AI Disclosure Notice (the “Notice”) explains how TreeHaous, Inc. (“TreeHaous,” “we,” “us,” or “our”) uses artificial intelligence and automated features in the Services, what those features can and cannot do, and how you should treat their output. Capitalized terms used but not defined here have the meanings given in the Terms of Service, into which this Notice is incorporated by reference. This Notice is provided for transparency and does not expand our liability beyond what the Terms provide.
The short version.Some features use AI to help you search and to provide insights and analytics. AI features are tools, not people, and not a licensed professional.AI output can be wrong, incomplete, or out of date. It is information, not real estate, legal, financial, or other professional advice.Always verify important information and consult a licensed professional before making a real estate decision.Our AI does not make decisions about you that produce legal or similarly significant effects.
1. Where We Use AI in the Services
We use artificial intelligence and automated methods in a limited, informational way, including for:
- AI-assisted search. Helping interpret your queries and surface relevant Listing Data and content.
- AI insights and summaries. Generating informational summaries or highlights about listings, areas, or market conditions (AI Output).
- Market analytics. Producing informational estimates and analytics, which are not appraisals or valuations.
The Canopy Feed is a separate, opt-in personalization surface. As described in the Privacy Policy, it orders content using your stated preferences and your own explicit signals (saves, searches, views, and likes) through transparent, hand-weighted rules, and does not use a machine-learning model as of the Effective Date.
1.1 Market Analytics Are Not Valuations or Lending Tools. Our market analytics are informational and are not used in connection with any mortgage-lending or property-valuation decision as of the Effective Date. They are not appraisals, automated valuation models (AVMs) used for lending, or determinations of value or creditworthiness. If analytics are ever used to inform a valuation or lending decision, that change falls within the lender/valuation sealed compartment, ties to the RESPA / settlement-service review gate in our internal compliance procedures, and requires assessment under applicable automated-valuation-model quality-control rules and a corresponding update to this Notice before launch.
1.2 Intended for Adults. Consistent with the Privacy Policy, the Services are intended only for individuals who are at least 18 years old and are not directed to minors. This 18-and-older posture is also relevant to TreeHaous remaining outside the minor-specific provisions of companion-chatbot and related AI statutes.
2. AI Features Are Tools, Not Humans or Professionals
2.1 Not a Human. When you interact with an AI feature, you are interacting with software, not a person. We identify AI features clearly and conspicuously at the point of interaction so that you are not misled into believing AI Output comes from a human. In-product AI identification, and its verification, occur under our internal procedures; the operational requirement that this labeling appear in product — not only in this Notice — is addressed in Section 7.1.
2.2 Not a Licensed Professional. AI features are not, and do not act as, a licensed real estate agent or broker, appraiser, attorney, lender, financial advisor, or any other licensed professional, and AI Output is not professional advice. Licensed services are provided by the Sponsoring Brokerage and licensed Agents, not by the Company or its AI features.
2.3 Not a Decision-Maker About You. Our AI features inform and assist; they do not make automated decisions about you that produce legal or similarly significant effects (such as decisions about housing eligibility, credit, or terms). See Section 5.
2.4 AI-Generated Content. Identifying an AI feature (Section 2.1) is distinct from labeling AI-generated content or output. Where we generate content using AI — such as AI-generated listing summaries or descriptions, or any synthetic media — we will provide provenance labeling as applicable law and emerging standards require. This is consistent with the prohibition on AI-generated fake listings and synthetic or deceptive media in the Acceptable Use Policy.
3. Limits of AI Output; No Reliance
3.1 AI Can Be Wrong. AI Output is generated by automated methods and may be inaccurate, incomplete, outdated, or unsuitable for your situation. It may reflect limitations or errors in underlying data, including Listing Data, and may not capture the most current information.
3.2 Informational Only. AI Output, Canopy ordering, and market analytics are provided for general informational purposes only and are not real estate, legal, financial, tax, appraisal, lending, insurance, or investment advice. They are not a substitute for the judgment of a qualified licensed professional.
3.3 Verify Before You Rely. You are responsible for independently verifying any information that matters to your decision and for consulting appropriate licensed professionals. To the maximum extent permitted by law, and as provided in the Terms, we disclaim liability for decisions made in reliance on AI Output, Canopy ordering, or analytics.
4. How AI Features Use Your Information
AI features operate on inputs such as your queries, your stated preferences, Listing Data, and content available in the Services. Our handling of Personal Information in connection with AI features is governed by our Privacy Policy, including the sections on Behavioral Telemetry and on your choices and rights. We do not use AI features to covertly record, transcribe, or analyze your private Communications, and we do not extract biometric information from the photos or videos you upload.
4.1 Training Data. Consistent with the Acceptable Use Policy, the applicable MLS data licenses, and the Copyright/DMCA Policy, we do not use MLS Content to train artificial-intelligence or machine-learning models or to build competing systems, and MLS Content is not ingested into any such model or dataset.
4.2 Third-Party AI Providers. Some AI features may be provided using third-party AI service providers engaged under contract, consistent with the service-provider framing in the Privacy Policy and our vendor-management procedures. We do not identify specific providers here so that this Notice remains accurate as providers change.
5. Automated Decision-Making and Personalization
5.1 Today. As of the Effective Date, we do not use automated decision-making, including profiling, that produces legal or similarly significant effects about you. AI features and the Canopy Feed inform content ordering and provide information; they do not determine your access to housing, credit, or any benefit, and they do not set terms that affect you.
5.2 If This Changes. If we introduce model-based personalization, AI-driven recommendations that could influence housing-related outcomes, or any automated decision-making subject to applicable law, we will update this Notice and the Privacy Policy and provide the disclosures, choices, and any opt-out or appeal rights that applicable law requires. This is the housing “consequential decision” / ADM trigger — activating it requires Fair Housing review and the state-law disclosure analysis in Section 7 before launch.
6. AI and Fair Housing
We design our informational AI features to avoid steering or discrimination. AI features and the Canopy Feed must not be used to express or facilitate any preference, limitation, or discrimination based on a protected class, consistent with the Acceptable Use Policy. You may not use AI features to generate discriminatory content or to circumvent fair-housing requirements. If we expand AI-driven personalization, we will assess fair-housing implications, including the risk that neutral signals could produce disparate effects, before launch.
7. Legal Status of This Notice and AI Features
7.1 Transparency Baseline; In-Product Labeling Required. We provide AI disclosures to support transparency consistent with the Federal Trade Commission Act and applicable state law. Where a reasonable person might otherwise be unsure, we identify AI features as AI. This Notice is not sufficient on its own: the FTC-Act transparency baseline and applicable state disclosure statutes generally require clear-and-conspicuous disclosure at the point of interaction with each AI feature, and a standalone written notice alone may not satisfy a “clear and conspicuous” requirement. Accordingly, this Notice may not be relied on as the sole means of AI disclosure, and it should not be published as the AI-disclosure mechanism unless clear-and-conspicuous, in-context AI identification is implemented in product at the point of interaction with each AI feature. In-product labeling and its verification occur under our internal procedures.
7.2 Informational — Not a “Companion” System; Pre-Launch Boundary Assessment. Our AI features are informational tools for real estate search, insights, and analytics. They are not “companion” or relationship-simulating AI systems and are not designed to simulate a sustained personal or emotional relationship. Laws directed at companion chatbots are generally not intended to apply to informational tools of this kind. Because the Services include a deployed conversational AI search assistant, the companion-boundary question is current. The boundary is contested and fact-specific. Before launch, and before introducing any name, personality, persistent memory across sessions, or other relationship-simulating behavior, we will assess whether the deployed conversational AI remains an informational tool or crosses into the scope of companion / relationship-simulating AI statutes.
7.3 Real Estate Context. Some states require clear and conspicuous disclosure when automated tools are used to interact with consumers in connection with the sale or advertising of real estate. We provide AI identification consistent with these requirements where applicable.
7.4 No Expansion of Liability. This Notice is informational. Nothing in it expands the Company’s obligations or liability beyond the Terms, and the disclaimers and limitations in the Terms apply to AI features and AI Output.
8. Changes to This Notice
We may update this Notice as our AI features evolve or as the law changes. We will post the updated Notice with a new “Last Updated” date and, where appropriate, provide additional notice. Material changes to AI features that affect your rights will be reflected here and, where required, in the Privacy Policy.
