Acceptable Use Policy

This Acceptable Use Policy (the “Policy”) is part of and incorporated into the TreeHaous Terms of Service (the “Terms”). Capitalized terms used but not defined in this Policy have the meanings given in the Terms. If there is a conflict between this Policy and the Terms, the Terms govern. By accessing or using the Services, you agree to comply with this Policy.
This Policy applies to all Users, including Consumer Users, Verified Professionals, and MLS Member Users. Verified Professionals and MLS Member Users are subject to additional obligations under the applicable professional terms and under Real Estate Laws and MLS rules.
1. Purpose and Scope
This Policy describes conduct that is required and prohibited when using the Services. Its goals are to keep the Services lawful, safe, and trustworthy; to protect Users and third parties; to support the Company’s compliance with Real Estate Laws, Privacy Laws, and MLS rules; and to preserve the integrity of Listing Data and the Platform. The Company may enforce this Policy in its discretion as described in Section 17.
Application to all forms of access. This Policy applies equally however you access or interact with the Services, including through websites and applications; any API, SDK, or data feed; browser extensions; AI agents, assistants, or other automated tools; integrations and connected services; third-party applications the Company authorizes; and any future Platform features. You are responsible for the conduct of any tool, agent, or person acting on your behalf or through your account or credentials, and conduct undertaken through automated means is attributed to you as if undertaken directly.
2. General Conduct Requirements
You agree to use the Services only for lawful purposes and in compliance with these requirements. You will:
- comply with all applicable laws, including Real Estate Laws, Privacy Laws, consumer-protection laws, and advertising laws;
- provide accurate information about yourself, your licensure, and any property or listing you reference;
- respect the rights, privacy, and safety of other Users and third parties; and
- use the Services consistent with their intended purpose and the Terms.
3. Fair Housing and Non-Discrimination
Fair housing compliance is mandatory. The Services may not be used to discriminate, to express or imply a discriminatory preference or limitation, or to facilitate discriminatory conduct in the sale, rental, financing, advertising, or availability of housing.
3.1 Protected Classes
You may not make, publish, display, or transmit any User Content, listing description, profile, comment, review, advertisement, or Communication that indicates or suggests any preference, limitation, restriction, or discrimination based on race, color, religion, sex (including gender identity and sexual orientation), disability, familial status, or national origin under the federal Fair Housing Act, or based on any additional class protected under applicable state or local law, which may include source of income, marital status, age, ancestry, military or veteran status, immigration status, criminal history (where regulated), or other protected characteristics.
3.2 Prohibited Statements and Signals
Without limiting the foregoing, you may not use the Services to:
- describe a property, neighborhood, or community using language that signals a preference for or against any protected class, including coded or indirect language;
- steer, or attempt to steer, any person toward or away from a property, neighborhood, or community on the basis of a protected class;
- ask about, record, or use a person’s protected-class status to make or influence a housing decision;
- refuse to deal, set different terms, or provide different information or service on the basis of a protected class; or
- publish advertising or content that a reasonable person would read as expressing a discriminatory preference.
3.3 Professional Users
Verified Professionals and MLS Member Users are independently responsible for their own compliance with the Fair Housing Act and all applicable fair-housing and real-estate-advertising laws and MLS rules in their licensed activity. The Company’s role as a near-passive technology provider does not relieve any professional of these obligations.
3.4 No Reliance on the Company
The Company does not provide fair-housing legal advice. Compliance with this Section is your responsibility. The Company’s review or non-review of any content does not constitute approval or a determination of compliance.
4. Prohibited Content
You may not post, upload, transmit, or make available any User Content that:
- is unlawful, fraudulent, deceptive, defamatory, obscene, harassing, threatening, or hateful;
- violates fair-housing or anti-discrimination law (see Section 3);
- infringes or misappropriates any intellectual property, privacy, publicity, or other right of any person, including unauthorized use of photographs, video, floor plans, or listing media;
- contains another person’s Personal Information without authorization, or discloses private or sensitive information;
- misrepresents a property, its price, status, or availability, or misrepresents your identity, affiliation, or license status;
- is a fake, duplicate, expired, or bait-and-switch listing, or a fake or fraudulent agent or brokerage profile, review, testimonial, credential, or license;
- is synthetic, manipulated, or AI-generated media (including deepfakes) that misrepresents a real person, property, listing, or event, or that is presented in a deceptive manner;
- contains malware or harmful code, or links to such material;
- constitutes unsolicited commercial communication except as permitted in Section 10; or
- is otherwise prohibited by the Terms or applicable law.
5. Prohibited Activities (General)
In addition to the conduct prohibited elsewhere in this Policy, you may not:
- Scrape or harvest. Use any robot, spider, scraper, crawler, or other automated means to access, copy, monitor, index, harvest, or extract Listing Data, MLS Content, User Content, Platform Content, or other materials, except as expressly authorized in writing (see also Sections 8 and 13);
- Circumvent controls. Bypass, disable, or interfere with any security, authentication, rate-limiting, geographic (geo-gate), age, or access-control feature, including the United States–only territorial restriction and the 18+ age requirement;
- Interfere. Interfere with, disrupt, or overload the Services or the networks or infrastructure supporting them;
- Reverse engineer. Reverse engineer, decompile, disassemble, or attempt to derive the source code, architecture, models, or trade secrets of the Services, except to the limited extent this restriction is unenforceable under applicable law;
- Misuse accounts. Create accounts by automated means, maintain multiple accounts to evade enforcement, share or transfer credentials, or access the Services using another person’s credentials;
- Falsely claim licensure. Represent yourself as a licensed professional or MLS member without valid, current licensure and verification; or
- Facilitate violations. Use the Services to enable, induce, or help any other person or automated agent to do any of the above or anything else prohibited by this Policy.
6. Prohibited AI Conduct
The Services include AI Features. You must use AI Features lawfully and in good faith. Without limiting any other Section, you may not, and may not permit or enable any other person or automated agent to:
- Manipulate or attack the AI. Attempt prompt injection, jailbreaks, adversarial prompting, or any technique intended to manipulate, corrupt, or subvert AI Features or their outputs, or to cause AI Features to violate this Policy, the Terms, or applicable law;
- Extract system instructions. Extract, reconstruct, or attempt to discover any system prompt, hidden instruction, model, weights, parameters, or other underlying configuration of the AI Features;
- Evade moderation. Use AI Features or AI Output to generate, disguise, or distribute content that evades or is intended to evade moderation, filtering, or detection;
- Generate prohibited content. Use AI Features to create or facilitate deceptive, unlawful, discriminatory, fraudulent, harassing, or infringing content, including fake or fraudulent listings, agent or brokerage profiles, reviews, testimonials, credentials, or licenses; synthetic or stolen identities; deepfakes; or content that impersonates any person or entity;
- Train competing systems. Use the Services, Platform Content, Listing Data, MLS Content, User Content, or AI Output to train, fine-tune, develop, benchmark, or improve any artificial-intelligence or machine-learning model, large language model, or dataset, or to ingest any of the foregoing into any such model or dataset; or
- Automate abuse. Use AI Features or automated agents to generate prohibited content at scale or to carry out any other conduct prohibited by this Policy.
AI Features are tools, not professionals. AI Output is informational only and is not professional advice; the informational nature and limits of AI Features are described in Section 12 and the AI Disclosure Notice.
7. Platform Manipulation and Integrity
To protect the integrity of the Services, their rankings, feeds, and reputation signals, you may not, and may not permit or enable any other person or automated agent to:
- Fabricate engagement. Generate or inflate likes, follows, saves, views, shares, comments, reviews, ratings, or other engagement or reputation signals by artificial, automated, incentivized, or deceptive means, including engagement farming and click farms;
- Manipulate ranking and recommendations. Manipulate or attempt to manipulate search results, the Listing Feed, the Canopy Feed, recommendations, trending or featured surfaces, or any ranking, scoring, or reputation system;
- Operate fake or coordinated accounts. Create, operate, or maintain fake, automated, bot, sock-puppet, or Sybil accounts; operate bot networks; create accounts by automated means; or engage in coordinated or inauthentic behavior across accounts;
- Artificially amplify. Engage in artificial amplification, vote manipulation, review manipulation, or any other scheme to distort the visibility, prominence, or perceived popularity or reputation of any content, listing, account, or professional.
8. Security
You must respect the security and integrity of the Services. You may not, and may not permit or enable any other person or automated agent to:
- Probe or scan. Conduct vulnerability scanning, penetration testing, or any probing, scanning, or testing of the Services or their systems without the Company’s prior written authorization;
- Attack authentication. Engage in credential stuffing, brute-force attacks, password spraying, token theft, session hijacking, or any attempt to bypass authentication, authorization, or rate limits;
- Deploy malicious code or attacks. Introduce, distribute, or attempt to deploy malware, ransomware, viruses, exploits, or other malicious code, or conduct denial-of-service or distributed-denial-of-service attacks;
- Phish or socially engineer. Conduct phishing, pretexting, or other social-engineering attacks against the Company, Users, or third parties;
- Develop exploits or discover vulnerabilities. Develop exploits against, or attempt to discover, access, or exploit security vulnerabilities in, the Services, except under an authorized program as described below.
Security research requires prior written authorization. Good-faith security research or testing is permitted only with the Company’s prior written authorization and within the scope it specifies. Suspected vulnerabilities should be reported to accounts@treehaous.com and not exploited or disclosed without authorization.
9. Fraud Prevention
You may not use the Services to engage in or facilitate fraud or deception, including to:
- Falsify identity or credentials. Use a fake or stolen identity or synthetic identity, or forge, alter, or misuse any license, credential, or document;
- Post fraudulent listings. Create fake, duplicate, or bait-and-switch listings, or misrepresent a property, its price, status, terms, or availability;
- Commit financial or transaction fraud. Engage in escrow fraud, wire fraud, payment fraud, or any scheme to divert funds or deceive a party to a transaction;
- Phish or socially engineer. Use phishing, spoofing, or social engineering to obtain credentials, funds, or information;
- Impersonate. Impersonate or falsely claim affiliation with any person, Agent, brokerage, MLS, MLS GRID, the Company, a regulator, or a government agency; or
- Market deceptively. Engage in deceptive, false, or misleading marketing or advertising.
10. Communications, Messaging, and Email
10.1 User-to-User Messaging. Direct messages and other Communications must comply with this Policy. You may not use messaging to harass, defraud, spam, or transmit prohibited content, or to engage in discriminatory steering.
10.2 No Unlawful Commercial Messaging. You may not use the Services to send unlawful, unsolicited, or deceptive commercial messages. Any commercial email you are permitted to send through or in connection with the Services must comply with the CAN-SPAM Act and applicable law, including accurate header and subject information, identification as an advertisement where applicable, a valid physical postal address, and a functioning opt-out.
10.3 No Platform-Originated Texting Abuse. The Services do not send platform-originated text messages as of the Effective Date. You may not use any contact information obtained through the Services to send unlawful calls or texts, including in violation of the Telephone Consumer Protection Act or applicable state law.
10.4 Recording. You may not record, intercept, or transmit any Communication in violation of applicable wiretap or two-party-consent laws, including Illinois law.
11. Privacy and Data Protection
You must respect the privacy of others. You may not collect, store, or use other Users’ Personal Information except as necessary for a legitimate, lawful interaction permitted by the Services, and you must handle any such information in compliance with Privacy Laws. Verified Professionals using CRM or contact features must have a lawful basis for processing contact information and must honor applicable privacy rights and opt-outs. Without limiting the foregoing, you may not, and may not permit or enable any other person or automated agent to:
- Scrape or harvest personal data. Scrape, harvest, or collect Personal Information or contact information of Users or third parties from the Services by automated or manual means;
- Enrich, combine, or profile. Engage in unauthorized profiling, data enrichment, or the combination of data obtained from the Services with other data (including purchased or third-party data) to identify, target, or build profiles of Users;
- De-anonymize. Attempt to re-identify or de-anonymize any Aggregated or De-Identified Data or any de-identified User;
- Resell or redisclose. Sell, license, or otherwise disclose Personal Information obtained through the Services, except as expressly permitted; or
- Surveil or track. Conduct unauthorized surveillance, monitoring, or tracking of Users or third parties.
12. Use of AI Features and Automated Outputs
AI Output, Canopy Feed ordering, and market analytics are provided for informational purposes only and are not professional advice. You may not present AI Output as independently verified fact, as the Company’s advice, or as a substitute for professional judgment. You may not use AI Features to generate or disseminate content that violates this Policy, including discriminatory or deceptive content. Prohibited conduct directed at the AI Features themselves is addressed in Section 6, and the informational nature and limits of AI Features are further described in the AI Disclosure Notice.
13. Intellectual Property; Listing Data and MLS Protections
13.1 Respect for Rights and Attribution. You must respect intellectual property rights and the integrity of Listing Data and MLS Content. You may not remove, alter, or obscure any attribution, disclaimer, watermark, source statement, or notice required by the Terms, the applicable MLS rules, MLS GRID, or the listing broker. Copyright complaints are handled under the Company’s Copyright/DMCA Policy.
13.2 MLS and Listing Data Restrictions. Listing Data and MLS Content are licensed under contractual MLS and MLS GRID rules, and their protection is essential to the Company’s continued access to that data. You may use Listing Data and MLS Content only for personal, non-commercial use to identify properties of potential interest, or, for Verified Professionals, as expressly permitted by the applicable MLS rules and the MLS Display & Data Use Addendum. Without limiting the Terms, you may not, and may not permit or enable any other person or automated agent to:
- Train AI or ingest into models. use Listing Data or MLS Content for artificial-intelligence or machine-learning training, fine-tuning, or development, or for LLM ingestion, embedding, or incorporation into any model, vector store, or dataset;
- Build competing or derivative databases. build, populate, or maintain any competing database, derivative dataset, or compilation derived from Listing Data or MLS Content;
- Redistribute, republish, or syndicate. commercially redistribute, republish, syndicate, resell, license, or sublicense Listing Data or MLS Content, or republish it outside the scope of the authorized MLS licenses;
- Automate extraction and harvesting. scrape, crawl, or use automated means to extract Listing Data or MLS Content, including listing photographs and descriptions, or engage in automated or commercial screenshot harvesting or metadata harvesting; or
- Publicly display metadata. publicly display MLS GRID Metadata, which is licensed for internal use only.
These restrictions protect the Company’s contractual MLS rights and are in addition to the prohibitions in Sections 5 and 8 and the MLS Display & Data Use Addendum.
14. Export Controls and Sanctions
You must comply with all applicable U.S. export-control and economic-sanctions laws and regulations, including those administered by the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) and the U.S. Commerce Department. You may not use the Services if you are located in, ordinarily resident in, or organized under the laws of any embargoed or comprehensively sanctioned country or territory, or if you are identified on any U.S. government restricted-party or sanctions list, and you may not use, export, re-export, or transfer the Services in violation of any applicable embargo, sanction, or export-control restriction. This Section supplements the export-control and sanctions provisions of the Terms.
15. Reporting Violations
If you become aware of content or conduct that violates this Policy, you may report it through the in-product reporting tools or by contacting the Company at accounts@treehaous.com. Reports of claimed copyright infringement should follow the Copyright/DMCA Policy. Suspected security vulnerabilities should be reported as described in Section 8. The Company reviews reports and takes action in accordance with the Content Moderation & Appeals Policy.
16. Additional Rules for Professional Users
Verified Professionals and MLS Member Users additionally agree that they will:
- hold and maintain all licenses, credentials, and qualifications required for their activity, and keep their licensing and professional information accurate and current;
- maintain their brokerage affiliation and comply with their brokerage’s and the Sponsoring Brokerage’s supervision;
- comply with all MLS rules, including display, attribution, and data-use requirements, and use Listing Data only in a manner consistent with the applicable MLS data license;
- comply with real-estate advertising laws, including required disclosures and truthful representation of their role, license status, and brokerage;
- not share their credentials, and not permit any unauthorized assistant, staff member, or other person to access or use the Services under their professional credentials;
- promptly update their professional information, and promptly notify the Company if any license, membership, affiliation, or authorization lapses, is suspended, or is revoked;
- cooperate with reasonable compliance investigations and requests for verification or documentation (see Section 18); and
- remain solely responsible for their licensed advice, representations, and conduct.
These obligations supplement, and do not replace, the Professional/Agent User Terms and the MLS Display & Data Use Addendum.
17. Enforcement
17.1 Range of Actions. The Company may, in its discretion and to the extent consistent with applicable law, take action in response to actual or suspected violations of this Policy, including removing or restricting content or listings; disabling, limiting, or throttling features or accounts; imposing partial or feature-level suspensions; suspending or terminating accounts; revoking verification or professional privileges; requiring additional verification or documentation; and reporting unlawful activity to authorities or affected third parties (including an applicable MLS, MLS GRID, or the Sponsoring Brokerage).
17.2 Factors. Where practical, the Company considers the severity, intent, and recurrence of a violation, and the risk to Users, third parties, the Services, and the Company’s MLS relationships, in deciding what action to take. Fair-housing, safety, fraud, security, and MLS-compliance violations may warrant immediate action.
17.3 No Obligation to Monitor. Consistent with the Terms, the Company is not obligated to monitor User Content or to detect violations, and it acts as a provider of an interactive computer service. Its decision to act or not act in any instance does not waive its rights or create any obligation to act in other instances.
17.4 Appeals. Enforcement decisions affecting User Content or accounts may be appealed as set out in the Content Moderation & Appeals Policy. That Policy is the sole source of the moderation standards and appeals procedure; this Policy does not restate them.
18. Investigations and Cooperation
18.1 Investigation Authority. The Company may investigate suspected violations of this Policy, the Terms, or applicable law. In connection with an investigation, a dispute, a security incident, or a legal or regulatory matter, the Company may, subject to the Privacy Policy and applicable law: preserve, access, and review account information, User Content, logs, and other records; preserve evidence and implement legal holds; request additional verification or documentation; and freeze, restrict, or suspend access to an account or features while an investigation is pending.
18.2 Cooperation with Authorities. The Company may cooperate with regulators, an applicable MLS or MLS GRID, and law enforcement, and may preserve and disclose information where it believes in good faith that doing so is reasonably necessary to comply with applicable law, a subpoena, court order, warrant, or other legal process or governmental request, or to enforce this Policy or the Terms, in each case consistent with the Privacy Policy.
18.3 User Cooperation. You are expected to cooperate in good faith with reasonable compliance investigations and verification requests, including by providing accurate information and documentation the Company reasonably requests. Failure to cooperate may itself result in enforcement action under Section 17.
19. Reservation of Rights
To protect Users, the integrity of the Services, and the Company’s MLS and brokerage relationships, the Company reserves the right, in its discretion and to the extent consistent with applicable law, to: remove or restrict content or listings; disable, limit, or throttle features or accounts; revoke verification; suspend or revoke professional privileges; require additional verification or documentation; and take any other action it considers necessary or appropriate to preserve Platform integrity, protect Users and third parties, comply with law, and protect its MLS and brokerage relationships. The Company’s decision not to exercise or enforce any right under this Policy does not waive that right, and all rights not expressly limited are reserved.
20. Changes to This Policy
The Company may update this Policy from time to time as described in the Terms. Material changes will be communicated by reasonable means, and continued use of the Services after changes take effect constitutes acceptance.
